Hypoxic Ischemic Encephalopathy (HIE)

Hypoxic ischemic encephalopathy (HIE) is a brain injury occurring when a fetus fails to receive enough oxygen. It can also be referred to as “perinatal encephalopathy” when the birth injury is sustained  by a newborn.

If brain cells are deprived of oxygen, they die. When this happens, long-term damage can occur. Some examples of this long-term damage are cerebral palsy and other severe developmental problems.

In general, the longer a newborn goes without oxygen, the greater the severity of the brain damage will be. Preventable in many cases, HIE is often irreversible.

The attorneys at Balkin & Eisbrouch understand the long-term impact that a birth injury such as HIE can have on a family and the child. We can investigate the circumstances surrounding the birth injury and determine whether or not you have the basis to file a lawsuit against the medical staff, doctor or hospital due to medical negligence and malpractice. The causes of HIE

Due to HIE, the infant may develop many problems such as cerebral palsy, developmental delays, cognitive impairments, motor impairments, and epilepsy.  In order to have a successful birth, the medical staff must have proper medical equipment available. They also need qualified personnel, and the ability to react quickly and competently to any emergency that may occur during birth.

Some of the common causes of HIE include:

  • Uterine rupture
  • Problems with the umbilical cord
  • Failure to perform a Cesarean section (C-section)
  • Diabetes in the birth mother
  • Fetal distress
  • Shoulder dystocia

If the attending staff commits medical malpractice or acts in otherwise negligent manner, a birth injury lawsuit may be warranted.

Filing an HIE lawsuit may help

A small percentage of children who suffered from HIE go on to live normal, healthy, happy lives. In most cases, they face the prospect of a lifetime of medical care, challenges, hardships, and expenses that can grow enormously. An HIE lawsuit offers hope to the families as well as the children who have been made to suffer at the hands of negligent medical staff.
