In Suffolk County, Massachusetts, $23.8 million was awarded to a family who filed a cerebral palsy lawsuit after the the negligence of two doctors at Massachusetts General resulted in their child’s birth injuries. The infant was later diagnosed with cerebral palsy. The child suffers from seizures and requires a classroom aide and special instruction during the school day. She also has severe mobility issues. The $23.8 million settlement includes healthcare costs, lost future wages, and damages.

Birth injuries result in cerebral palsy lawsuit

The plaintiffs allege that the child was born in 2005 with bleeding on the tissues surrounding the brain. The head trauma was reportedly the result of the use of a vacuum extractor, a device intended to accelerate child birth. According to the complaint, the doctor did not warn the plaintiffs of the potential risks involved with the device.

The plaintiffs further allege that for a long period of time during the labor, the doctor did not check on the health of the mother or the baby, nor did she check on the progress of the labor. Meanwhile, the nurses steadily increased the mother’s dosage of Pitocin, a drug intended to cause labor contractions. The cerebral palsy lawyer for the plaintiffs argued that not only did the drug harm the baby, but that the mother should have been offered a cesarean section.

Medical negligence can lead to birth injury settlements

Birth injuries can often arise as a result of medical negligence. In some cases, errors on the part of medical staff members can cause the infant to suffer from hypoxia, or low oxygen levels. A prolonged labor and failure to perform a cesarean section in a timely manner can also cause birth injuries. A cerebral palsy lawsuit or similar complaint may also be filed if the doctor used a vacuum extractor device, as was the case in the lawsuit that resulted in $23.8 million in compensatory damages.
